Terms of Use of Legalkite (ToU)

1. Introduction
1.1. These ToU constitute a contract between you and Legalkite SA.
1.2. They govern your use of our websites, applications, services, and content ("Services").
1.3. By using our Services, you accept these ToU. If you do not accept them, you may not use Legalkite.
2. Changes to the ToU
2.1. We may modify the ToU at any time.
2.2. If a change is significant, we will inform you before it takes effect.
2.3. After the effective date, your continued use of Legalkite constitutes acceptance of the new ToU. If you refuse the modifications, you must delete your account.
3. Content Published by Users
3.1. Ownership of Content
You retain all rights to the content you create and publish on Legalkite.
3.2. License Granted to Legalkite
By publishing public content on Legalkite, you grant Legalkite a free, non-exclusive license to store, display, reformat, and distribute your content, as well as to use it to promote Legalkite.
3.3. Responsibility for Content
You are fully responsible for the content you publish.
3.4. Sensitive Data Prohibited
It is strictly forbidden to publish sensitive data of third parties.
3.5. Copyright Compliance
It is forbidden to publish content violating third-party intellectual property rights.
3.6. Content Removal
We may remove content at any time. You may delete your content or your account.
4. Our Services and Rights
4.1. Intellectual Property
Legalkite owns all rights to the interface, design, and code.
4.2. Prohibited Uses
Accessing non-public areas, bypassing security, disrupting the platform, or scraping is forbidden.
4.3. Service Modifications
We may modify or discontinue the Services without prior notice.
5. Data and Privacy
5.1. Data Protection
Legalkite does not sell or transfer your data.
5.2. Data Storage
All data is stored in cloud centers located in Switzerland.
6. Security
If you identify a security vulnerability, please inform us.
7. Warranty and Liability
7.1. No Warranty
The Services are provided "as is" and "as available".
7.2. Limitation of Liability
Legalkite is not liable for damages resulting from use of the Services.
7.3. User Responsibility
Users must regularly back up their content.
7.4. Inaccuracy of Content
Legalkite does not guarantee accuracy or reliability of content.
8. General Provisions
8.1. Waiver
Failure to exercise a right is not a waiver.
8.2. Severability
If a provision is invalid, the others remain applicable.
8.3. Applicable Law and Jurisdiction
Swiss law applies. Courts of Sarine have jurisdiction.
8.4. Entire Agreement
The ToU constitute the full agreement.
8.5. Reference Version
The French version prevails.

"Swiss Hosts": Swiss cloud providers.
"License": Authorization to use public content.
